Auction terms:

1. The Godot Gallery, on behalf of the consignors, acts as a commercial representative, organising, arranging and conducting the auction. Items are displayed in the order listed in the catalogue, with the auctioneer announcing in real time the catalogue number of the item coming up and its opening bid, after which prospective buyers make their offers by raising their bid cards. Bidding is permitted only by those who have registered by name and address before the auction begins, using a bid card. Buyers express their acceptance of the auction terms by taking possession of the bid card, which serves as an indication of that acceptance.
Telephone bidding is also possible, though it requires prior registration, which we can accept no later than the day before the auction.
We also accept advance purchase orders at the auction, where you can set the amount you would offer for the item if you participate in person. If, during the auction, a bid of the same amount as the purchase order comes in from the hall or by telephone, the purchase order takes priority.

2. The ownership of the item is transferred from the seller by a hammer strike to the auction buyer who submits the highest bid, except in the case of a protected item indicated in the catalogue, where the Hungarian state enforces the pre‑purchase right granted by the 2001. évi LXIV. tv.

3. The Gallery, acting as a commercial agent, represents the auctioneer (principal) in their name and on their behalf, and, based on the principal’s full authority, proceeds accordingly. The Gallery is authorised by that authority to enter into a sales contract with the highest‑bid buyer at the auction and to receive the purchase price. The Gallery reserves the right to exclude from auction any items listed in the catalogue.

Bid staircase ascent
Between 50.000 Ft and 100.000 Ft there is 5.000 Ft.
10.000 Ft between 100.000 Ft and 200.000 Ft.
Between 200.000 Ft and 500.000 Ft there is 20.000 Ft.
From 500.000 Ft to 1.000.000 Ft in 50.000 Ft increments.
Between 1.000.000 Ft and 2.000.000 Ft lies 100.000 Ft.
Between 2.000.000 Ft and 5.000.000 Ft, 200.000 Ft, etc.

4. The buyer must pay 20% of the hammer‑price as a deposit in cash immediately at the auction. If the full purchase price is paid in a single instalment at the auction, the item can be collected on site. The commercial representative ensures that the auction buyer can settle the remaining purchase amount exceeding the deposit within 14 days from the time of the auction. The deposit, when paid within the deadline, is applied towards the purchase price. If the auction buyer fails to pay the full purchase price to the auctioneers by the specified deadline, the commercial representative shall regard the buyer’s offer as void. In that case, the deposit paid by the buyer is not refundable.

5. The purchaser owes a brokerage fee to the commercial representative, amounting to 22 % of the selling price. The brokerage fee includes VAT.

6. Following settlement of the purchase price, the buyer must arrange for the removal of the item bought at their own cost and under their own responsibility. If they fail to do so, the commercial representative is not liable for damage to the item, and from 15 days after the auction a monthly debt charge of 5% of the purchase price is imposed. If the auction buyer, despite repeated demands, still does not deliver the commissioned item after the auction, then after 6 months the commercial representative may freely sell the item – after deducting the costs – leaving the remainder held in trust for the buyer's benefit.

7. Any interference or venture aimed at persuading a third party to purchase a high‑price offer over the issued securities, thereby causing damage, is forbidden.

8. At the pre‑auction exhibition every item may be viewed. The items are sold as they are, without warranty and with all their defects and shortcomings, in the condition they are in at the time of the auction. The descriptions and illustrations in the catalogue serve only for identification, so buyers must, before the auction, assess the condition of the lots themselves and confirm whether they match the catalogue descriptions. After the auction there is no scope for objections or revocation, except where an item is a forgery, even if the catalogue records it as genuine. In that case the auction buyer may exercise a revocation in writing within 3 months from the first doubt about the item's provenance or authenticity, but no later than 3 years from the auction date. The Gallery undertakes to repurchase the sold item against its auction price and the auction agent fee, within 3 years from the contract date, from the revoking party, provided an independent forensic expert determines that the item is not genuine.

9. Items that are sold cannot be purchased below the declared price.

10. If an auction purchaser does not wish to attend the auction in person, the Gallery will make bids on their behalf in accordance with the purchase instruction they have provided. Please send your purchase instructions at least 24 hours before the auction. Acceptance of a purchase instruction requires a deposit of 20 %, which will be refunded if the bid is unsuccessful. If the purchase instruction succeeds, the entire deposit is to be treated as a reservation, and the normal rules for purchasers present at the auction will apply otherwise. If a third party places a higher‑value instruction for the same item, or if other auction purchasers outbid, the absent purchaser will receive the deposit back in full after the auction, without any deductions.

11. Bidding by telephone is also possible. If two purchase orders are of the same amount, the earlier one will be given priority.

12. The cost of delivery is borne by the buyer.

13. Items marked “PROTECTED” in the auction catalogue cannot be taken out of Hungary. The museums register the current owners of these items, and any change of ownership must be reported.

14. The 2001 year, LXIV Law, regulates the export of cultural goods. Cultural goods can only be removed from the country with the approval of the Cultural Heritage Protection Authority.

15. At the end of the auction, you may request a re‑auction of objects that did not sell from the commercial representative.
