Auction terms:
The Godot Gallery organizes, arranges and conducts the auction on behalf of the auctioneers as a commercial representative. Bidding is only possible online after registration, which requires a name, phone number and e‑mail address, and must be completed before the auction begins. By registering, buyers acknowledge that they accept the auction conditions as binding. Registration and bidding can be done on the www.bodaofart.com website.
The title of ownership of the item is transferred by a strike to the auction seller to the buyer who has made the highest bid, except when the item listed as PROTECTED in the catalogue, the 2001 year LXIV. Act, the pre‑purchase right granted to the state is exercised by the Hungarian government.
As a commercial representative, the Gallery acts on behalf of the consignor, fully authorised in that capacity. Under this authority it may conclude the sales agreement with the highest bidder at the auction and receive the purchase price.
The Gallery retains the right to waive the auction of certain items listed in the catalogue.

The buyer is obliged to pay the broker a commission equal to 22 percent of the setting price. The commission includes VAT. The setting price and the commission together form the purchase price.
The buyer undertakes to pay the purchase price to the auctioneer within 14 days following the auction. This may be done in cash or by bank transfer. The details must be arranged personally by e‑mail or phone with the auctioneer on the 06702217893‑th phone number or at the [email protected] e‑mail address.
The items that have been purchased may be collected in the gallery after telephone coordination (+36703816775 or +36702217893). Taking the current situation into account, the seller agrees that, if requested, following the settlement of the purchase price the goods will be delivered free of charge within Budapest to the buyer, provided that the purchase price exceeds 200.000 Forint.
If this does not succeed, the buyer must arrange to have the purchased item shipped at their own cost and responsibility. If they fail, the commercial representative is not liable for damage to the item, and from the day after the auction 15 a monthly storage fee calculated on the purchase price of 5 % will be charged. If the auction buyer, despite requests, does not deliver the consigned item after the auction, then after 6 months the commercial representative may sell the item freely – after deducting costs – and will hold the remaining amount as a deposit in favour of the buyer.
It is forbidden to engage in any form of intrigue or endeavour that aims to entice a third party into purchasing a property at an excessively high price, thereby causing damage.
In the pre‑auction exhibition, every item is viewable. The items are sold in their present condition, without any warranty, and with all defects and shortcomings present at the time of the auction. The descriptions and illustrations in the catalogue serve only for identification, so buyers must, prior to the auction, assess for themselves the state of the lots and whether they conform to the catalogue descriptions. No objection or rescission is permitted after the bid, except where an item is counterfeit – even though it is listed as genuine in the catalogue. In such a case the bidding purchaser may rescind in writing within 3 months from the first doubt about the item's provenance or authenticity, but no later than 5 years from the day of the auction. The Gallery undertakes to repurchase the sold item, against the sale price and the auction broker’s fee, within 5 years from the execution of the sale contract, if an independent expert records that it is not genuine.
Objects for sale cannot be purchased below the bid price.
If an auction buyer does not wish to attend the auction in person, the Gallery will place bids on their behalf in accordance with the purchase instruction they have given. Please ensure that your purchase instructions reach us 24 hours before the auction. Acceptance of a purchase instruction requires a deposit of 20 percent, which will be refunded in the event of an unsuccessful bid. If a purchase instruction succeeds, the full deposit amount is considered a reserve; otherwise the rules applicable to buyers attending in person apply. If a third party places a higher purchase instruction for the same piece, or if an auction buyer places a higher bid, the absent buyer will receive their deposit back in full after the auction without any deductions.
The web site’s automatic bidding agent performs a similar function in the current online auction, allowing one to specify the maximum amount desired for the particular item.
There is also the possibility of bidding by telephone. In the event of identical offers, the first offer received is given priority.
It is governed by the 2001 law of the LXIV year. Cultural assets may only be permanently removed from the country with the permission of the Cultural Heritage Protection Office.
At the end of the auction, you can request a re-auction of items that did not sell from the commercial representative. This can be done by phone or email from the day after the auction.
